This Policy regulates the procedure for collecting and processing personal data and other confidential data of users of the Trianon Energy mobile application using automation tools through gas stations and the Internet (hereinafter referred to as the Privacy Policy).
1.1. Personal data is any information relating to a directly or indirectly identified or identifiable individual (subject of personal data).
1.2. Processing of personal data - any action (operation) or set of actions (operations) performed using automation tools or without the use of such means with personal data, including collection, recording, systematization, accumulation, storage, clarification (updating, changing), extraction, use, transfer (distribution, provision, access), depersonalization, blocking, deletion, destruction of personal data.
1.З. Confidentiality of personal data is a mandatory requirement for the Operator or any other person who has access to personal data to not allow their distribution without the consent of the subject of personal data or the presence of another legal basis.
1.4. A mobile application is a program for mobile devices installed on the User’s device running iOS and Android mobile operating systems.
1.5. Copyright holder is the person who owns the right to use and distribute the mobile application and who processes personal data of Users - Trianon Motors LLC Foreign Company.
1.6. “User is a person using the “Trianon Energy” mobile application.
1.7. Automated processing of personal data - processing of personal data using computer technology.
1.8. Providing personal data - actions aimed at disclosing personal data to a certain person or a certain circle of persons.
1.9. Blocking of personal data is a temporary cessation of processing of personal data (except for cases where processing is necessary to clarify personal data).
1.10. Destruction of personal data - actions as a result of which it becomes impossible to restore the contents of personal data in the personal data information system and (or) as a result of which material media of personal data are destroyed.
1.11. Personal data information system is a set of personal data contained in the database and information technologies and technical means that ensure their processing.
1.12. Device identifier - unique data that allows you to identify the User’s device on which the mobile application is installed, provided by the device itself or calculated by the mobile application.
2.1. The provision by the User of his personal data during Registration, when using a mobile application, means the User’s consent to the terms of the Privacy Policy, including the User’s consent to the processing of his personal data by the Copyright Holder, in cases where the provisions of the current legislation require such consent.
2.2. In case of disagreement with the terms of the Privacy Policy, the User must stop using the “Trianon Energy” mobile application.
2.3. The User's withdrawal of consent to the processing of personal data is grounds for blocking the User's access to the “Trianon Energy” mobile application.
2.4. The privacy policy applies to the “Trianon Energy” mobile application. The mobile application does not control and is not responsible for third party mobile applications that the User can access via advertising links that may pop up in mobile windows in the “Trianon Energy” application.
2.5. The Copyright Holder does not verify the accuracy of the personal data provided by the User.
2.6. The materials contained in the “Trianon Energy” application are protected by applicable copyright and trademark laws.
3.1. The copyright holder does not transfer any personal information publicly or to third parties, except when required by the legislation of the Republic of Uzbekistan.
3.2. The copyright holder is not responsible for the safety of the user's electric vehicle when using “Trianon Energy” electric filling stations.
3.3. The user in the online queue outperforms the live queue. However, “Trianon Energy” is not responsible for problems with queues.
3.4. Purchased kW are non-refundable.
4.1. Each User, per device, is granted permission to temporarily download one copy of the “Trianon Energy” application for personal, non-commercial temporary use only.
4.2. Installing and registering the application means agreeing to the right to receive a temporary license for the use of the application by the User, and not transferring ownership rights. Under this user license, the User has no right to:
-modify or copy materials;
-use the materials for any commercial purposes or for any public display (commercial or non-commercial);
-attempt to decompile or reverse engineer any software contained in the “Trianon Energy” application;
-remove from the application any materials indicating copyright or other proprietary rights of the Copyright Holder;
- transfer the materials to another person or “mirror” the materials on any other server.
4.3. This license shall automatically terminate if the User violates any of these restrictions and may be terminated without cause at Trianon Energy's discretion at any time.
4.4. Upon terminating your use of this Application or upon the termination of this license, you must destroy any downloaded materials in your possession whether in electronic or printed format.
5.1. The user has the right:
5. 1.1. Make a free decision to provide your personal data necessary to use the “Trianon Energy” mobile application and consent to their processing.
5.1.2. Update, supplement the provided information about personal data if this information changes.
5.1.3. The User has the right to receive from the Copyright Holder information regarding the processing of his personal data, unless such right is limited by law. The User has the right to demand from the Copyright Holder clarification of his personal data, its blocking or destruction if the personal data is incomplete, outdated, inaccurate, illegally obtained or is not necessary for the stated purpose of processing, as well as take measures provided by law to protect his rights.
5.2 The copyright holder is obliged:
5.2.1. Use the information received solely for the correct operation of the application at “Trianon Energy” charging stations.
5.2.2. Ensure that confidential information is kept secret, not disclosed without the prior written permission of the User, and also not sell, exchange, publish, or disclose in other possible ways the transferred personal data of the User, except when required by law.
5.2.3. Take precautions to protect the confidentiality of the User's personal data in accordance with the procedure usually used to protect this type of information in existing business transactions.
5.2.4. Block personal data relating to the relevant User from the moment of application or request from the User, or his legal representative or the authorized body for the protection of the rights of personal data subjects for the period of verification, in the event of detection of unreliable personal data or unlawful actions.
6.1. In the event of loss or disclosure of confidential information of the User, the Copyright Holder is not responsible if this information:
6.1.1. Became public property before its loss or disclosure.
6.1.2. Was received from a third party prior to its receipt by the Copyright Holder.
6.1.3. Was disclosed with the consent of the User.
6.2.1. The Copyright Holder or its suppliers shall not be liable for any damages (including, without limitation, damages for loss of data, profit or due to business interruption) arising out of the use or inability to use the “Trianon Energy” application, even if “Trianon Energy” representatives or authorized representatives of the company have been notified orally or in writing of the possibility of the risk of such damage.
6.3.1. The materials in the “Trianon Energy” application are provided on an “as is” basis. The Copyright Holder makes no warranties, expressed or implied, and hereby disclaims all other warranties, including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement.
6.4.1 The Copyright Holder does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its website or otherwise relating to such materials or on any sites linked to “Trianon Energy”.
7.1. The materials appearing on the “Trianon Energy” App could include technical, typographical, or photographic errors. “Trianon Energy” does not warrant that any of the materials on the “Trianon Energy” App are accurate, complete, or current. “Trianon Energy” may make changes to the materials contained in the application or other media at any time without notice. However, “Trianon Energy” does not undertake any obligation to update the materials.
8.1. The Copyright Holder has not reviewed all of the sites linked to its application and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by “Trianon Energy” of the site. Use of any such linked website is at the User's own risk.
9.1. The Copyright Holder may revise these terms of service for its application at any time without notice. By using the “Trianon Energy” Application, you agree to be bound by the then current version of these Terms of Service.
10.1. The Copyright Holder receives data about the User’s location (geolocation data) through the mobile application. Geolocation data is transferred to the Copyright Holder only during the use of the mobile application. The User, at his own discretion, may prohibit the transfer of geolocation data by changing the appropriate settings of his mobile device, however, this may make it impossible to use the mobile application.
11.1. To be able to make non-cash payments using bank cards, the User can link a bank card to his profile. Linking a bank card is carried out by the User independently in the mobile application in accordance with the instructions of each payment system.
11.2. Payment by non-cash payment using bank cards is carried out in accordance with the rules of international payment systems on the principles of confidentiality and security of payment. The security of the data provided by the User is ensured by compliance of the procedures with the requirements of the payment card industry data security standard and no one, including the Copyright Holder, can obtain it. Bank card data is entered on the secure payment page of the Payment System, which provides the possibility of non-cash payment for services.
12.1. Before filing a claim in court regarding disputes arising from the relationship between the User and the Copyright Holder, it is mandatory to submit a claim (a written proposal or an electronic proposal for a voluntary settlement of the dispute).
12.2. The recipient of the claim, within 30 calendar days from the date of receipt of the claim, notifies the claimant in writing or electronically of the results of consideration of the claim.
12.3. If it is impossible to reach a peaceful agreement, the dispute will be referred to the court.
12.4. The current legislation of the Republic of Uzbekistan applies to the Privacy Policy and the relationship between the User and the Copyright Holder.
13.1. The Copyright Holder has the right to make changes to the Privacy Policy without the User’s consent.
13.2. The new Privacy Policy comes into force from the moment it is posted in the “Trianon Energy” mobile application, unless otherwise provided by the new edition of the Privacy Policy.
